should decline this Agreement and immediately stop using the Service. Access
to the Service is

- You
must provide your
legal full name, a valid email address, and any other information requested
in order to complete
the sign-up process.
- You
are responsible for
maintaining the security of your account and password. The service provider
cannot and will not be
liable for any loss or damage from your failure to comply with this security
obligation.
- Mobile application access
will not be given to users’ if they opt for free sign up but for a day.
- No
Third-party
integration services like payment, SMS etc. will be provided from our side.
- No
customisations will be
done from our side for any feature for free.
- Our
basic free plan is
available for lifetime for institutions having less than 1000 students.
- Logins will be provided
for teachers’, parents’, Students’ and administrator.
- Technical support is
provided to all the Account holders via e-mail.
- The
Terms of Service
shall be governed and interpreted in relations with the laws of India
applicable therein, without
regard to principles of conflicts of laws. The parties irrevocably and
unconditionally submit to
the exclusive jurisdiction of the courts of Ahmedabad, India with respect to
any dispute or claim
arising out of or in connection with the Terms of Service. The United
Nations Convention on
Contracts for the International Sale of Goods will not apply to these Terms
of Service and is
hereby expressly excluded.
- You
endorse and agree
that Genius Education Management may alter these Terms of Service at any
time by posting the
relevant updated and restated Terms of Service on Genius Education
Management's website, available
at http://www.geniusedusoft.com and such upgradation to the Terms of Service
are effective as of
the date of posting. Your persistent use of the Services after the amended
Terms of Service are
posted to Genius Education Management's website constitutes your agreement
to, and acceptance of,
the amended Terms of Service. If you do not agree to any changes to the
Terms of Service, do not
continue to use the Service.
- You
may not utilize the
Genius Education Management Service for any illicit or unapproved reason nor
may you, in the use
of the Service, damage any laws in your ward (counting but not limited to
copyright laws), the
laws pertinent to you in your client's purview, or the laws of India. You
will agree to every
single appropriate law, principles and directions in your utilization of the
Service.
- You
comply with our Terms
of Service and understand not to imitate, copy, duplicate, offer, exchange
or exploit any portion
of the Service, utilization of the Service, or access to the Service without
the special written
permission by Genius Education Management.
- Inquiries regarding the
Terms of Service ought to be sent to Support.
- You
recognize and agree
that your utilization of the Service, including data transmitted to or from
the Portal by Genius
Education Management, is represented by its Privacy Policy.
- The
parties have
necessitated that the Terms of Service and all reports relating thereto be
prepared in English.
- The
Client undertakes not
to harass, threaten, abuse or harm the Service Provider or other users of
the Service in any way.
- You
are responsible for
all Content posted and activity that occurs under your account (even when
Content is posted by
others who have accounts under your account).
- The
Client undertakes to
maintain full confidentiality over the Client's passwords related to the
Service and the Client's
Account. If the Client becomes aware of any unauthorized use of its password
or of the Client's
Account, the Client must notify the Service Provider immediately at support
at geniusedusoft.com.
- Among
other things the
Service Provider does not represent and warrant to the Client that The
Client's use of the Service
will meet the Client's requirements.
- the Client's use of the Service will be uninterrupted, timely, secure or
free from error;
- any information obtained by the Client as a result of the Client's use of
the Service will be
accurate, correct, reliable and up to date;
- defects in the operation or functionality of the Service will be
corrected.
- You
agree not to
reproduce, duplicate, copy, sell, resell or exploit any portion of the
Service, use of the
Service, or access to the Service without the express written permission by
Service Provider.
- You
must not upload,
post, host, or transmit unsolicited email, SMSs, or "spam" messages.
- In
case the Agreement has
been translated into some other language than English and there are
contradictions between the
English version and the translation, then the English version shall prevail
over the translation.
- Access to all modules
will not be provided under free sign-ups.
- Terms
& conditions can be
changed at anytime.
- We
may, but have no
obligation to, remove Content and Accounts containing Content that we
determine in our sole
discretion are unlawful, offensive, threatening, libelous, defamatory,
pornographic, obscene or
otherwise objectionable or violates any party's intellectual property or
these Terms of Service.
- The
Agreement is governed by the laws of Republic of India.
